These Terms of Service (“Terms”) govern your use of the SoundbathPlayer online course platform, including my.soundbathplayer.com and online.soundbathplayer.com, and any related content delivery sites operated by Beyond Percussion (collectively referred to as the “Site”), as well as any services, course materials, and digital content provided through the Site (“Services”).
An active account is required to register for and access any courses or Services. When you proceed with registration, you authorize us to create an account for you and to collect the necessary information to set it up, including your name, email address, and any other details required to deliver the Services. By creating an account, accessing the Site, or using any Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Site.
We reserve the right to update or modify these Terms at any time without prior notice. Any changes will be posted on this page and are effective immediately upon publication.
Acceptance and Eligibility
By creating an account or accessing the Site, you represent and warrant that:
- You are at least 18 years old.
- You have the legal capacity to enter into these Terms.

- You will comply with these Terms and applicable laws.
We may suspend or terminate access for users who do not meet these requirements.
User Accounts and Security
Access to course materials requires an account. You are responsible for safeguarding your account credentials and agree that:
- You will not share your login or password with others.
- You will not allow others to access the Site using your account.
- You will notify us immediately of suspected unauthorized access at [email protected].
We reserve the right to suspend or terminate accounts involved in password sharing, unauthorized access, or misuse.
Intellectual Property
All course materials, videos, audio lessons, worksheets, training methods, scripts, text, images, software, downloads, community content, and other materials available on the Site (collectively, “Content”) are the intellectual property of Beyond Percussion and are protected by U.S. and international copyright and trademark laws.
You are granted a limited, non-transferable license to access Content for personal educational use only. You may not:

- Publish or post Content anywhere online.
- Use Content to create derivative work or train others.
- Use Content for commercial purposes.
- Share or resell course access or materials.
All rights not expressly granted are reserved.
Prohibition on AI Use
You may not upload, submit, or use any Content from the Site with any artificial intelligence (AI) system for:
- AI training or dataset creation
- Machine learning model development
- Generative AI output
- Derivative educational or commercial use
Permitted Use / Restrictions
You agree not to:
- Interfere with Site security or operations.
- Use the Site to distribute malware or harmful code.
- Harass, threaten, or harm other users.
- Frame, scrape, or attempt to reproduce Site content.
- Bypass access controls or copy protection.
- Violate third-party privacy or intellectual property rights.
Course Terms, Payments, and Access
Payment terms, refunds, dispute policies, and course access duration are governed by the Group Soundbath Player Course Terms and Conditions Agreement, which you must sign separately before registering for a course.
By enrolling, you acknowledge that:
- Course access is granted for one (1) year unless otherwise stated in the Course Agreement.
- Refunds are only provided according to the Course Agreement.
- Violation of these Terms or the Course Agreement may result in termination of access without refund.
Disclaimer – No Professional or Therapeutic Claims
Course Content is for educational purposes only and does not constitute medical, psychological, therapeutic, wellness, or health advice. Beyond Percussion does not provide healthcare services or professional certification through this Site.
You acknowledge that:
- No course offers medical treatment or counseling.
- Course participation does not qualify you to provide therapy.
- You are solely responsible for the use or application of any material learned.
Non-Disparagement
You agree not to make or encourage any false, misleading, or defamatory statements about Beyond Percussion, SoundbathPlayer, instructors, or staff in any public forum including social media, online reviews, or groups. Feedback or concerns must be directed to [email protected].
Suspension or Termination
We may suspend or terminate your account without refund if you:
- Violate these Terms or the Course Agreement
- Share or misuse course materials
- Engage in abusive, unethical, or illegal conduct
- Infringe intellectual property rights
- Disrupt class environments or communities
Accuracy of Information
Course materials and content are provided “as is” for educational purposes only. We do not guarantee the accuracy, completeness, or reliability of information provided.

With your consent, we may send you SMS/MMS messages related to your account or course access. Message/data rates may apply. Reply STOP to unsubscribe.
Liability
To the maximum extent permitted by law:
- The Site and Services are provided “as is” without warranty.
- We disclaim all implied warranties including fitness and merchantability.
- We are not liable for indirect, incidental, or consequential damages.
Dispute Resolution and Arbitration
All disputes arising out of these Terms will be resolved through binding arbitration in San Bernardino County, California in accordance with the rules of the American Arbitration Association. You waive the right to participate in any class action dispute.
Governing Law
These Terms are governed by the laws of the State of California, without regard to conflicts of law principles.
Severability
If any provision is found unenforceable, the remaining provisions will remain in effect.
